I reimaged my computer about a week ago, and MP 2 started working fine. That's a heck of a workaround if that's the only way to get this game to work. Try updating or rolling back video drivers? I think MP1 has trouble with bit OS'es I seem to remember reading that. I played max payne 2 on windows 7 and never had any problems.
I run Windows 7 Home. They both run fine. Never any problems with 1 or 2. File does not exist or it is not a valid savegame file.
